Justice Naomi Ellenbogen, presiding over the appeal, supported the tribunal's conclusion that the comment was inherently related to sex. She noted that baldness is significantly more common in men than women, making the insult gendered. The judge compared the remark to commenting on a woman’s breast size, stating that both involve characteristics more prevalent in one gender and could therefore breach equality laws.

Company challenges while court upholds the decision

Company argued that baldness affects both men and women and that the comment was not specifically related to Finn’s gender or masculinity.In November 2023, the Employment Appeals Tribunal dismissed the company’s appeal.
