DELHI | 6TH JULY 2025– Popular North India-based restaurant chain Swagath has approached the Delhi High Court against a Telangana-based hotel chain operating under the same name, alleging trademark infringement. The case is titled Ms Swagath v Dhanturi Hari Shankar & Anr.
SWAGATH SEEKS CANCELLATION OF RIVAL’S TRADEMARK
Along with the infringement suit, Swagath Delhi has also filed a petition seeking cancellation (rectification) of the rival hotel’s registered mark.
On July 4, Justice Amit Bansal issued notices in both the infringement suit and the rectification petition.
COURT TO CONSIDER INTERIM RELIEF ON AUGUST 27
The Court has listed the matter for consideration of interim relief on August 27, 2025.
“Let the plaint be registered as a suit… List before the Court on 27th August, 2025 for consideration of the application for interim injunction,” the Court ordered.
BACKGROUND OF THE DISPUTE
Swagath Delhi, which operates a chain of restaurants across North India, has argued that it has acquired considerable goodwill and reputation under the mark ‘SWAGATH’.
On the other hand, Hotel Swagath, the defendant, has been using the mark ‘SWAGATH’ since 1991 and currently operates 11 establishments across Telangana. The hotel chain also operated an establishment under the same name in Dubai for three years.
